2. Scope and acceptance
These Terms of Service govern the use of the website and purchases made through the Albuquerque & Cortez store.
By using the website or completing an order, the customer confirms that they have read and understood these Terms, the Privacy Policy, the Refund Policy and the Shipping Policy.
Use of the store and the conclusion of purchase contracts are subject to Portuguese law and the applicable European Union consumer-protection rules.
3. Products and availability
Albuquerque & Cortez endeavours to present product descriptions, photographs, features, colours, sizes, materials, prices and availability as accurately as possible.
Colours may vary slightly depending on the screen, device or settings used by the customer. These differences do not limit the consumer’s statutory rights when a product does not correspond to the advertised characteristics.
The inclusion of a product on the website does not guarantee its permanent availability. If an item becomes unavailable after an order has been placed, the customer will be informed and will receive a refund of the amount paid for the unavailable item.
4. Prices and taxes
All prices are shown in euros.
Prices displayed to consumers are final prices and include all legally applicable taxes, where due. Shipping costs are shown separately at checkout before the order is confirmed and paid for.
Albuquerque & Cortez may change its prices at any time, but such changes will not affect orders that have already been confirmed.
In the event of an obvious error in a product’s price, description or promotion, the customer will be contacted before dispatch. The customer may confirm the order using the corrected information or cancel it and receive a full refund of all amounts paid.
5. Orders and conclusion of the contract
To make a purchase, the customer must select the products, provide accurate billing and delivery information and complete payment using one of the methods available at checkout.
Before confirming the order, the customer may review the products, quantities, prices, shipping costs and information provided.
Once the purchase has been completed, a confirmation will be sent to the email address provided by the customer. The order is considered accepted when it is confirmed by Albuquerque & Cortez.
Albuquerque & Cortez may refuse or cancel an order in justified circumstances, including:
- The product is unavailable;
- Payment cannot be confirmed;
- The delivery details are incorrect or incomplete;
- There are reasonable indications of fraud;
- There is an obvious error in the price or description;
- Delivery is legally or logistically impossible.
When a paid order is cancelled by Albuquerque & Cortez, the corresponding amount will be refunded in full.
6. Payments
The available payment methods are shown at checkout and may vary according to the customer’s country or device.
Payments are processed through secure payment service providers. Albuquerque & Cortez does not directly store complete bank card details.
The order will be processed after payment has been confirmed or authorised by the payment provider.
7. Shipping and delivery
Orders are shipped in accordance with the Shipping Policy available at:
https://albuquerquecortez.eu/policies/shipping-policy
The stated delivery times are estimates and may be subject to change for reasons beyond the reasonable control of Albuquerque & Cortez. If a significant delay occurs, the customer may contact us for information and assistance.
The risk of loss of or damage to the products passes to the consumer only when the consumer, or a third party appointed by the consumer other than the carrier, takes physical possession of the products.
8. Right of withdrawal
For distance contracts, consumers have 14 days in which to withdraw from the contract without having to provide a reason.
This period begins on the day on which the consumer, or a third party appointed by the consumer other than the carrier, takes physical possession of the product. When an order contains multiple products delivered separately, the period begins on the date the final product is received.
To exercise this right, the consumer must clearly communicate their decision by contacting:
Following this notification, the products must be returned within the applicable statutory period and in accordance with the instructions provided by our team.
Unless the product is defective, damaged or incorrect, the direct costs of returning it when exercising the right of withdrawal will be borne by the consumer.
Albuquerque & Cortez will refund the payments covered by the right of withdrawal, including the cost of the standard delivery method originally offered, within the applicable statutory period. Additional costs resulting from the choice of a more expensive delivery method will not be refunded.
The refund may be withheld until the returned products have been received or until the consumer provides evidence that they have sent them back.
The full conditions are available in the Refund Policy:
https://albuquerquecortez.eu/policies/refund-policy
9. Exceptions to the right of withdrawal
The right of withdrawal may not apply in circumstances provided for by law, including:
- Products made to the customer’s specifications or clearly personalised;
- Sealed products that are unsuitable for return for health-protection or hygiene reasons where the seal has been removed after delivery;
- Products which, after delivery, have been inseparably mixed with other items;
- Other circumstances expressly provided for under applicable law.
These exceptions do not affect the consumer’s rights when a product is defective, damaged or does not correspond to what was ordered.
10. Legal guarantee and lack of conformity
Products sold are covered by the applicable legal guarantee. In Portugal, new movable goods are covered by a statutory liability period of three years from the date of delivery.
If a product does not conform to the contract, the consumer may be entitled, in accordance with applicable law, to:
- Repair;
- Replacement;
- A proportionate reduction in price;
- Termination of the contract.
The applicable remedy will depend on the nature of the problem and the conditions established by law.
To report a defect or lack of conformity, the customer must email apoio@albuquerquecortez.eu, providing the order number and a description of the problem. Photographs may be requested to assist with the assessment, without prejudice to the consumer’s statutory rights.
11. Promotions and discounts
Promotions are subject to the conditions, dates and products specified in the relevant communication.
Unless expressly stated otherwise, promotional codes cannot be combined and must be used before the order is completed. They cannot be applied retrospectively to completed purchases.
Promotional prices will be displayed clearly alongside the applicable reference price.
12. Use of the website
The customer agrees not to use the website to:
- Engage in unlawful or fraudulent activities;
- Attempt to gain unauthorised access to systems, accounts or data;
- Introduce viruses, malicious code or other harmful elements;
- Copy or use store content without authorisation;
- Provide false information when making a purchase.
Albuquerque & Cortez may restrict access to the website where there are indications of abusive, fraudulent or unlawful use.
13. Intellectual property
The Albuquerque & Cortez name, logo, website design and original store content are protected under applicable law.
Third-party trademarks, names and logos displayed on products belong to their respective owners. The sale of these products does not imply a partnership, official representation or special authorisation unless expressly stated otherwise.
No website content may be reproduced, distributed or commercially exploited without authorisation or a lawful basis.
14. Liability
Albuquerque & Cortez does not exclude or limit any liability that cannot lawfully be excluded, including consumers’ mandatory statutory rights.
We are not responsible for temporary website unavailability caused by maintenance, technical failures, external service providers or events beyond our reasonable control.
Nothing in these Terms limits the consumer’s statutory rights concerning delivery, conformity, guarantees, returns or refunds.
15. Data protection
Personal data is processed in accordance with the Privacy Policy:

17. Applicable law
These Terms are governed by Portuguese law, without prejudice to the mandatory consumer-protection provisions applicable in the consumer’s country of residence.
If any provision of these Terms is found to be invalid or unenforceable, this will not affect the validity of the remaining provisions.
